Article 1 – Definitions
In these Terms & Conditions the following definitions apply:
Cooling-off period: the period within which the consumer may exercise the right of withdrawal.
Consumer: the natural person who is not acting for purposes related to trade, business, craft, or profession and who concludes a distance contract with the trader.
Day: calendar day.
Long-term contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
Durable medium: any tool that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the option for the consumer to dissolve the distance contract within the cooling-off period.
Trader: the natural or legal person who offers products and/or services at a distance to consumers.
Distance contract: a contract concluded within the framework of a system organised by the trader for distance selling of products and/or services, exclusively using one or more means of distance communication until the conclusion of the contract.
Means of distance communication: a method that can be used to conclude a contract without the consumer and trader being in the same place at the same time.
Terms & Conditions: these present Terms & Conditions of the trader.

Article 3 – Applicability
These Terms & Conditions apply to every offer made by the trader and to every distance contract concluded and orders placed between trader and consumer.
Before the distance contract is concluded, the text of these Terms will be made available to the consumer. If this is not reasonably possible, the trader will indicate how the Terms can be viewed and that they will be sent free of charge upon request.
If the distance contract is concluded electronically, these Terms may be supplied electronically in such a way that the consumer can easily store them on a durable medium.
Where specific product or service conditions also apply, and there is a conflict, the consumer may rely on the most favourable provision.
Situations not covered by these Terms are to be assessed “in the spirit” of these Terms.
Article 4 – The Offer
If an offer has a limited validity period or is made subject to conditions, this will be clearly stated in the offer.
The offer is non-binding. The trader is entitled to amend or withdraw the offer.
The offer contains a complete and accurate description of the offered products and/or services. Images and descriptions are intended to represent the products truthfully, though variations in colour may occur.
Each offer contains information that makes it clear to the consumer what rights and obligations apply to acceptance, including:

the price (including VAT where applicable) and any shipping costs;

the way in which the contract will be concluded;

whether or not the right of withdrawal applies;
-
payment, delivery, and performance details;
-
the period for accepting the offer;
-
and any relevant cancellation terms.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and fulfils the stated conditions.
If accepted electronically, the trader confirms receipt without undue delay. Until receipt is confirmed, the consumer may dissolve the contract.
The trader takes appropriate measures to secure data transfer and ensure a safe web environment.
The trader may verify the consumer’s payment reliability and, if justified, refuse or attach conditions to an order.
Upon delivery, the trader provides:

the trader’s address for complaints;

withdrawal conditions;
-
warranty and after-sales information;
-
and termination instructions if applicable.
Contracts are subject to product availability.
Article 6 – Right of Withdrawal
The consumer may dissolve the contract within 14 days after receiving the product, without giving any reason.
During this period, the consumer must handle the product with care.
Products should be returned unused, in their original packaging and condition, including all labels and accessories.
To exercise the right of withdrawal, the consumer must notify the trader by email at info@grealishfashion.com within 14 days of receipt, and return the product within the following 14 days.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the return shipping costs are borne entirely by the consumer.
Returns must be sent to:

Refunds will be issued within 14 days after receipt of the returned goods, using the same payment method as the original transaction.
Article 8 – Exclusion of the Right of Withdrawal
The trader may exclude withdrawal for:

custom-made or personalised items;
-
products that cannot be returned for hygiene reasons (if the seal has been broken);
-
perishable or time-sensitive goods.
Article 9 – Price
Prices will not increase during the offer’s validity except due to changes in VAT or law.
All prices include VAT and are subject to typographical errors.
The trader is not obliged to deliver based on incorrect prices resulting from such errors.
Article 10 – Conformity and Warranty
The trader guarantees that the products comply with the contract, specifications, and applicable laws.
Defects must be reported by email within 14 days after delivery.
Products must be returned in original condition and packaging.
Warranty is void if:

the consumer or third parties have altered the product;
-
the product has been used contrary to instructions;
-
or damage occurred through improper handling.
Article 11 – Delivery and Execution
Orders are processed and dispatched with the greatest care.
The place of delivery is the address provided by the consumer.
Orders are shipped within 30 days unless stated otherwise.
If a delay occurs, the consumer will be informed and may cancel the order free of charge.
Risk transfers to the consumer upon delivery.
Article 12 – Long-term Contracts: Duration, Termination and Renewal
The consumer may terminate indefinite contracts with a notice period of one month.
Fixed-term contracts cannot be automatically renewed beyond their agreed period.
Article 13 – Payment
Unless otherwise agreed, payments must be completed within 7 working days of order confirmation.
In case of non-payment, the trader may charge reasonable recovery costs after prior notice.
Article 14 – Complaints Procedure
Complaints must be reported clearly and in writing within 7 days of discovering the issue.
The trader will respond within 30 days.
If longer investigation is required, an acknowledgment with estimated response time will be sent.
Valid complaints will be resolved through repair, replacement, or refund.
Article 15 – Disputes
Contracts between the trader and the consumer are governed exclusively by Dutch law, regardless of the consumer’s residence.
Consumers within the EU retain the protection of their national consumer laws.
